July 01, 2009Court Multiplies OCM's Fees by Fifty Percent
As readers of OCM's Session Watch may recall, in January 2009, Judge Gants issued a summary judgment decision awarding OCM's client, Paull Hejinian, treble damages and attorneys' fees on account of General American Insurance Company's knowing and willful violation of G.L. c. 176D. See Hejinian v. General American Insurance Company, 2009 WL 981732, (Jan. 13, 2009) (Gants, J.). Shortly after publication of the latest edition of the Session Watch, Judge Hinkle, who replaced Judge Gants in the BLS-1 session upon the latter's elevation to the Supreme Judicial Court, issued a decision on Plaintiff's Petition for Attorneys’ Fees. We are proud to report that the Court enhanced OCM's fees by fifty percent under the so-called lodestar method, and awarded Mr. Hejinian $406,683.75 in attorneys' fees and $20,360.27 in costs. In her decision, Judge Hinkle found that "an enhancement of the lodestar amount is justified in this case by the risk plaintiff's counsel took with their contingency fee agreement, by their efficiency in staffing, and by their relatively low hourly rates." The Court further found: "As is clear from the results, plaintiff's counsel had a sound litigation strategy, which they aggressively and thoughtfully pursued. The partners appropriately supervised their associates, and there was little or no overlap in tasks." To date, GALIC has not paid the judgment, which now totals approximately $4,000,000.

October 06, 2008 OCM congratulates its partner, Tom O'Connor, on completing the acquisition of Marathon Capital Group, LLC by Silvercrest Asset Management Group LLC ("Silvercrest"). Tom co-founded Marathon in March 2000, and helped build its assets to approximately $600 million at the time of the acquisition. Tom's experience as COO, compliance officer and general counsel of Marathon, in addition to his nearly 30 years of complex litigation and workout experience, will be invaluable to OCM's clients as Tom returns to the full-time practice of law in October 2008.
